Recent reports confirm a delay in the Packaging Act Implementation Act (VerpackDG). The reason for this is the European Commission’s extension of the standstill period under EU law until August 17, 2026.
This decision is slowing down the national legislative process, meaning that the law can no longer take effect as planned in parallel with the new EU requirements.
The problem
The European Union Packaging Regulation (PPWR) is EU law and will therefore take effect directly in all member states as scheduled on August 12, 2026.
- A temporary “legal vacuum” is emerging
- The old Packaging Act (VerpackG) remains in effect, but it conflicts in some respects with the new EU regulation.
- For the time being, there are no national penalties for violations of the PPWR.
Companies must be particularly cautious during this transition period and monitor both regulatory frameworks.
The requirements of the PPWR (such as new heavy metal limits or the EU Declaration of Conformity) will take effect in August.
