You are considered a producer if you:
    • Manufacture in Spain and place the goods on the market there for the first time.

    • Import goods into Spain and distribute them commercially there for the first time.

    • As an online retailer (B2C), ship goods from abroad directly to Spanish end consumers for the first time (distance selling).

    • As a marketplace operator, are liable for unregistered third-party sellers on your platform (subsidiary liability).

  2. Joining a take-back system: You must enter into a contract with a government-approved Collective System for Producer Responsibility (SCRAP).
