What exactly is the insolvency-proof guarantee?

Anyone selling electrical appliances in Germany must comply with important legal regulations. A key requirement is the insolvency-proof guarantee. Many companies underestimate the importance of this issue, but mistakes can lead to severe consequences, including a ban on sales.

What is the insolvency-proof guarantee?

Under the Electrical Equipment Act (ElektroG), manufacturers and importers must ensure that the disposal of their devices is financially secured. This applies even if the company itself were to become insolvent.

The financing of disposal must therefore be permanently guaranteed. Proof of this is filed with the EAR Foundation. Without this guarantee, you will not receive WEEE registration and may not legally sell your products in Germany.

Key facts at a glance

  • The goal: The costs of disposing of end-of-life equipment must be covered so that the government or other manufacturers do not have to bear them.
  • Affected products: The obligation applies to all devices that can be used in private households (B2C devices). Purely B2B products are exempt from this.

However: Devices that can be used for both private and commercial purposes (dual-use) are legally classified as B2C devices and are therefore subject to the warranty obligation.

  • Responsible parties: Anyone who places electrical appliances on the market in Germany for the first time – whether a manufacturer, importer, or online retailer. Foreign companies without a branch in Germany must appoint an authorized representative to assume these obligations (including the warranty) on their behalf.
  • Proof: The warranty must be officially recognized and registered with the EAR Foundation.

What happens if these requirements are not met?

If no valid warranty is provided, the authorities will take strict action: This may result in heavy fines and the revocation of registration for the affected type of equipment. Consequently, the product may no longer be sold on the German market.

Obligations for Manufacturers & Importers

  • Obtain a guarantee: Manufacturers and importers can either participate in a collective guarantee system or provide individual proof of guarantee, e.g., a bank guarantee or by depositing cash with local courts.
  • Submit proof: The guarantee must be reported to the EAR Foundation before sales begin.
  • Verify validity: The guarantee must be renewed or actively extended every year.
  • Alignment: The guarantee must precisely match your registered quantities and device types.
