Anyone who sells electrical and electronic equipment in Europe quickly realizes that implementation of the WEEE Directive is inconsistent. The regulations and obligations are structured differently in each country.
National registries, varying reporting formats, and country-specific EPR requirements present companies with bureaucratic hurdles.
The key pillars:
- The Authorized Representative: Anyone who markets products in a country but does not have a branch office there must appoint a local authorized representative. Important: The “one authorized representative per country” principle applies – and each country has its own strict rules for this.
- Participation in collective systems: Manufacturers must join collective take-back systems to finance the collection of end-of-life equipment.
- Proper disposal: Compliance with strict guidelines for the environmentally sound treatment and recycling of electronic waste is mandatory everywhere.
A Look at Germany
In Germany, this responsibility is managed by the ear Foundation (Elektro-Altgeräte Register).
- Registration with the ear Foundation: Mandatory for every brand and device type before sales begin.
- Insolvency-proof guarantee: Annual financial statement for B2C devices.
- ear Collection Coordination: Mandatory pickup of full containers at municipal recycling centers following allocation by the ear algorithm.
(In practice, this is automatically handled by the logistics service provider)
- Volume Reporting & Recycling: Monthly reporting of sales volumes and proof of proper disposal in accordance with statutory quotas.
Compliance with all requirements demands seamless monitoring. Anyone who underestimates local requirements risks substantial fines and sales suspensions.
