Important Legislative Change: New Take-Back Requirement for Disposable E-Cigarettes

Starting July 1, 2026, expanded regulations for the sale of single-use vapes will take effect. All retail outlets must now accept returns of used devices.

What exactly is changing?

  • For all retail outlets: This requirement applies immediately to any retail outlet that carries e-cigarettes or electronic tobacco heaters – regardless of the size of the store. This therefore also affects kiosks, gas stations, tobacco shops, and online stores.
  • Expanded product range: The requirement is not limited to single-use vapes but includes all e-cigarettes (including reusable systems, battery mods, and pods with battery connections) as well as electronic tobacco heaters.
  • No Purchase Requirement, No Receipt Required: Consumers can return used devices completely free of charge. A sales receipt is not required, and the return is not tied to the purchase of a new product.
  • Labeling Requirement: Effective immediately, retail outlets must clearly display a standardized take-back logo in the store (e.g., in the entrance area or at the checkout) to inform customers about the return option.

Previous Regulation:

Until now, free returns at retail locations were heavily dependent on the size of the sales area. Consumers usually had to resort to recycling centers, municipal collection points, or larger supermarkets and drugstores for disposal. Smaller retailers were left out.

The legal regulation was prompted by serious fire hazards in garbage trucks and sorting facilities caused by lithium-ion batteries improperly disposed of in household trash.

To consistently minimize these risks, the new amendment to the Electrical and Electronic Equipment Act (ElektroG) significantly simplifies the return process for consumers.

This not only ensures greater safety in the waste management sector but also increases the collection rate, reduces environmental impact, and safely returns valuable raw materials to the recycling loop.
