May 15: The deadline for reporting single-use plastics

Since the EWKFondsG came into effect, manufacturers have been required to report, by May 15 of each year, the single-use plastic products placed on the market in the previous calendar year – specifying the type and weight in kilograms.

The report is submitted digitally via the Federal Environment Agency’s DIVID platform.

Who is affected?

All companies that, as “manufacturers” (including importers and online retailers), make the following single-use plastic products available on the German market for the first time on a commercial basis are affected:

  • Food containers: For food intended for immediate consumption (to-go).
  • Bags & film packaging: Flexible packaging for food intended for immediate consumption.
  • Drink cups & containers: Including lids and caps (up to 3 liters in volume).
  • Carry bags: Lightweight plastic shopping bags.
  • Wet wipes & balloons: For household, personal care, and decorative use.
  • Tobacco products: Filters or products containing filters.
  • New as of 2026: Fireworks are also subject to the reporting requirement.

Important for foreign companies: Anyone selling directly to private households in Germany (e.g., via e-commerce) must appoint an authorized representative in Germany to fulfill the obligations via DIVID.

How much are the fees?

The fee is calculated in euros per kilogram of the reported quantity:

  • Tobacco products (with filters): €8.972/kg
  • Balloons: €4.340/kg
  • Lightweight plastic carrier bags: €3.801/kg
  • Drink cups: €1.236/kg
  • Bags & plastic film packaging: €0.876/kg
  • Beverage containers (non-returnable): €0.181/kg
  • Food containers (to-go): €0.177/kg
  • Wet wipes: €0.061/kg

Note: Audit requirement for quantities of 100 kg or more

Anyone who has placed 100 kg or more of a product type on the market in a calendar year is subject to the legal reporting requirement.

  • Audit requirement: The quantity report must be audited and confirmed by a registered expert or certified public accountant.
  • Deadline: The confirmation must be submitted digitally via the DIVID portal by May 15.

May 15 is a strict legal deadline, so companies that have not yet prepared their report should take immediate action. Be sure to allow plenty of time for the registration process on the DIVID platform, as the manual review by the Federal Environment Agency may take several days.
