Anyone who commercially places packaged goods into circulation in Germany is responsible for their disposal and recycling. The Packaging Act (VerpackG) sets forth strict rules for this purpose.
Compliance is monitored through the public LUCID registry maintained by the Central Packaging Register (ZSVR).
Who is subject to the registration requirement?
The requirement applies without exception to all first-time distributors of packaging filled with goods, regardless of whether these end up with private consumers (B2C) or in the commercial sector (B2B):
- Manufacturers who package their own goods.
- Online retailers who use shipping boxes, bubble wrap, and packing materials.
- Importers who bear legal responsibility for the packaged goods when they cross the border.
Important: There are no minimum quantities. Even small businesses, startups, and small-scale enterprises must register in the LUCID registry starting with the very first package shipped commercially.
How does the registration process work?
Registration is conducted entirely online via the LUCID portal.
The process consists of four main steps:
- Enter master data: Provide information about the company, its address, and a national identification number (e.g., commercial register number or tax ID number).
- Specify packaging types: Select all packaging categories used that are placed into circulation.
- Enter brand names: List all brand names under which the packaged goods are sold.
- Link to a recycling system: Use the LUCID number you received to enter into a fee-based license agreement with a dual system (recycling service provider) to ensure physical disposal.
Don’t forget to report quantities
In addition to the one-time registration, there is an ongoing obligation to report data. Companies must report their planned quantities (forecast) and, after the end of the year, the actual quantities consumed (annual report due by May 15) to both their dual system and, in identical form, to LUCID.
What does LUCID do, and why is the registry important?
The LUCID registry is operated by the Central Packaging Registry Foundation (ZSVR). It does not act as a waste disposal operator, but rather as a government regulatory body.
The system fulfills two main functions:
- Preventing free-riders: The ZSVR cross-checks the reported packaging volumes against data from the dual systems. This ensures that all market participants contribute fairly to the costs of collection and recycling.
- Creating market transparency: Since the LUCID database is publicly accessible, authorities, customers, and competitors can verify whether a company is registered.
